On October 1, the South Carolina Senate Medical Affairs Subcommittee will hold a hearing on Senate Bill S.323, also known as the “Unborn Child Protection Act.”
This is not just another abortion ban. S.323 would outlaw all abortions with no exceptions for rape, incest, or fatal fetal anomalies. It seeks to establish legal “personhood” for embryos and fetuses — even before implantation.
This could mean that anyone who accesses abortion care in South Carolina could be charged with homicide and potentially face the death penalty if convicted.
“Personhood” laws like this have also been used to target contraception (such as Plan B and IUDs) and restrict fertility treatments like IVF.
S.323 is one of the most extreme and dangerous attacks on reproductive freedom in modern history.
